The FTC treats online marketing the same as using the phone so it is
covered by its Mail and Telephone Order Rule.

This was the old rule. Now, the time starts ticking as soon as the
seller receives a "properly completed Order" and all the information
needed to process it. If you get a credit card number the time starts to
tick even if you don't process it.

If no time is specified in the ad, you have 30 days to ship. If you
specify a time to ship in the ad, that time frame will govern.

The rule does apply to drytesting as well unless you disclose that the
orders will not be filled absent sufficient demand..
