Monitor settings, trends and the law - questions

Question 1: Does anyone have data (or a data source) on what is the most
prevalent setting for monitors? 640x480? 800x600? I doubt higher
resolutions will be the most prevalent.
Reason: a client wants frames. (I'm not a huge fan of them). If I do
design with frames, what is the most prevalent monitor setting, or can they
be set to resize. I have downloaded Netscape's frame documentation, but
this is not addressed. It seems a big marketing mistake to design for the
lowest common denominator and let the site look bad for higher-res viewers,
and a worse mistake to let those who view at 640x480 have content squeezed
out of view! Comments greatly appreciated.

Question 2: Java v. VDO Live v. no animation/video: Have any of you
experienced *significantly* slower load times when a Java applet is
implemented? I took an applet off a site because I was afraid the "bells
and whistles" were interfering with viewers' ability to get to my content
in a timely fashion. And has there been any word on whether the VDO Live
plug-in will become a part of the next rev, or part of any other browser?
I feel that asking someone to download a plug-in to get my client's sales
message is a bit of an imposition <g>.

Question 3: Legal responsibility for content in a BBS, Chat or List
environment - has that shaken out a bit or is the ISP still liable for
content? Anybody else running into this issue lately? Is there a website
on current Internet legal rulings and ramifications?
